Judge Adams initially raised the possibility that the missing jury was ready to return to court at 2 pm on Monday or 10 am on Tuesday. In such a situation, she hesitated to dismiss him because all 12 juries had “listened very carefully since 16th December”.
However, late Monday morning, she told the jury that he needed to be dismissed and left the remaining 11 juries to deliberate the case.
“Well, jury, there was an update from the missing jury advising him that he was still in the hospital because I told you last,” Judge Adams said.
She said he wouldn’t leave the hospital until Tuesday and would have to return to the hospital later in the week for testing. In New South Wales, a minimum of 10 juries can proceed.
Judge Adams also said, “COVID-19 has approached the jury’s head again in Sydney,” so if the jury wants to use it, “you don’t have to wear a cloth mask,” but the court can use a face mask. Said.
The court has already restructured the jury seats so that the juries are separated from each other.
Judge Adams told the jury that the court “let me know if there is anything else I can do to make you feel comfortable and safe.”
Judge Adams has given a closing remark to the jury before retiring to consider the verdict.
